ENVIRONMENTAL PERMITS IN TURKEY

1. ENVIRONMENTAL IMPACT ASSESSMENT REGULATION

 

Article 6 and others:

 

-        “Environmental impact assessment is positive” decision

-        “Environmental impact assessment is not required” decision

 

The above mentioned decisions are to be obtained from the Ministry of Environment and Forestry in order to initiate the investment. If not, projects will not be able to receive subsidy, urban plan approval (including Environmental Order Plan), construction and utilization (residence) permits. Two types of EIR are specified in the EIA Regulation: full EIR and project description files. Coverage of these sub groups are declared in the attached lists.

 

 

2. SOIL POLLUTION CONTROL REGULATION

 

Article 18.

 

-    Permit for waste water treatment sludge utilization in soil.

 

To be obtained from the provincial governorate.

 

 

3. USED OIL CONTROL REGULATION

 

Article 10, 25 and 27.

 

-    License for used oil regeneration/reuse facilities.

-    Quota permit from the Ministry of Environment and Forestry.

-    Declaration on the status of permit compliance.

-    Preliminary license for the facility

-    Market permit for the product to be obtained from the Ministry of Energy (Petroleum Affairs Directorate)

 

Required for engine oil producers and importers.

 

 

5. CONSTRUCTION DEBRIS CONTROL REGULATION

 

Article 16 and 38.

 

-        Permit for deposition of the construction debris.

 

To be obtained from the Municipality in municipal areas or from the governors/subgovernors in other areas for more 2 tons of construction debris.

 

 

6. WRAPPING MATERIALS CONTROL REGULATION

 

Article 20 and 37.

 

-    License for collection, re-cycle/reuse facilities.

 

To be obtained from the Ministry of Environment and Forestry.

 

 

7. USED BATTERIES CONTROL REGULATION

 

Article 7, 22 and 27.

 

-        License for collection

-        License and/or preliminary permit for re-cycle/reuse facilities.

-        Quota permit for battery producers.

 

Collection licenses are to obtained from the local governorates/subgovernorates. Facility licenses and quota permits are to be obtained from the Ministry of Environment and Forestry.

 

 

8. WASTE COLLECTION FROM THE SHIPS AND WASTE CONTROL REGULATION

 

Article 6.

 

-        Permit for waste collection/acceptance form the ships at harbors.

-        License for waste treatment facilities at the harbors.

 

Permits are to be obtained from the Ministry of Environment and Forestry by the Harbor Managers.

 

 

9. WATER POLLUTION CONTROL REGULATION & CIRCULAR FOR THE ADMINISTRATIVE PROCEDURES FOR WATER POLLUTION CONTROL REGULATION

 

Article 29, 38, 40, 42 and others.

 

-        Waste water discharge permit.

-        Industrial waste water discharge permit.

-        Deep sea discharge permit.

-        Waste water connection permit.

 

To be obtained from the various authorized administrations.

 

 

10. AIR POLLUTION CAUSED BY DOMESTIC HEATING CONTROL REGULATION

 

Article 23, 29 and others.

 

-        Production permits for domestic coal and/or lignite.

-        Market and/or sales permit for domestic coal and/or lignite.

-        Emission permits for incinerators.

 

To be obtained from the governorates of where the coal is produced and marketed. The last permit is to be obtained from the Ministry of Environment and Forestry.

 

 

11. INDUSTRIAL AIR POLLUTION CONTROL REGULATION

 

Article 11, 12 and others.

 

-    Emission permits.

 

Coverage of the permit is explained in the Regulation. Permits are to be obtained from the local governorates and/or from the Ministry of Environment and Forestry.

 

 

 

 

 

12. ENVIRONMENTAL NOISE POLLUTION CONTROL AND MANAGEMENT REGULATION

 

 

Article 4 and others.

 

-    Noise control permit.

 

To be obtained from the local governments.

 

 

 

13. MEDICAL WASTES CONTROL REGULATION

 

 

Article 35 and others.

 

 

-    Permit for locations of the incinerators.

 

From the governorates/subgovernorates.

 

-        Permit for sterilization facilities

 

From the Ministry of Environment and Forestry.

 

 

14. POLLUTION CAUSED BY THE HAZARDOUS MATERIALS IN THE AQAUATIC ENVIRONMENT CONTROL REGULATION

 

Article 11 and others.

 

 

-    Hazardous material discharge permits.

 

 

 

15. URBAN WASTE WATER TREATMENT REGULATION

 

Article 9.

 

-    Waste water connection permits.

 

 

PS:

 

BESIDE THE ENVIRONMENTAL PERMITS/LICENSES MENTIONED ABOVE THERE ARE SEVERAL OTHER PERMITS FOR THE CONTRUCTION, UTILIZATION AND OPERATION PERMITS FOR THE FACILITIES AS REGULATED BY THE LAW ON URBAN PLANNING, LAW ON WORKPLACES ESTABLISHMENT AND OPERATION.
